1. Acceptance of Terms
By downloading, installing, or using the iOxu mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and iOxu Team ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting in the App.
2. Description of Service
iOxu is an educational mobile application designed to help students in Azerbaijan prepare for various exams. Our services include:
- Interactive quizzes with multiple question types
- Progress tracking with XP points and achievements
- Leaderboards and social competition features
- Study reminders and goal setting
- Offline learning capabilities
- Multiple exam type preparations (Abituriyent, Magistratura, MIQ, Civil Service, etc.)
3. User Accounts
3.1 Account Creation
To access certain features of the App, you must create an account. You may create an account using:
- Email and password
- Apple Sign-In
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access to your account
- Providing accurate and up-to-date information
3.3 Account Security
You agree not to share your account with others or allow others to access your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. Subscriptions and Payments
4.1 Free Tier
iOxu offers a free tier with limited daily access to quizzes and features. Free users may have:
- Limited number of daily quiz attempts
- Access to basic features
- Advertisements (if applicable)
4.2 Premium Subscription
Premium subscriptions provide unlimited access to all features. Subscriptions are processed through the Apple App Store and are subject to Apple's terms and conditions.
4.3 Subscription Terms
- Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually)
- Auto-renewal: Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current period
- Price changes: We may change subscription prices. Any price changes will apply to subsequent billing periods
- No refunds: Subscriptions are non-refundable except as required by applicable law
4.4 Cancellation
To cancel your subscription, you must do so through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until then.
4.5 Subscription Management
Our subscriptions are managed through RevenueCat. By subscribing, you also agree to RevenueCat's terms of service.
5. User Conduct
You agree not to:
- Cheat: Use any unauthorized methods to manipulate quiz results, XP points, or leaderboard rankings
- Abuse: Harass, threaten, or abuse other users through any feature of the App
- Exploit: Attempt to exploit bugs, vulnerabilities, or weaknesses in the App
- Automate: Use bots, scripts, or automated tools to interact with the App
- Share inappropriately: Share your account or distribute premium content without authorization
- Reverse engineer: Attempt to decompile, reverse engineer, or extract source code from the App
- Impersonate: Impersonate another person or entity
- Violate laws: Use the App for any unlawful purpose
6. Intellectual Property
6.1 Our Content
All content in the App, including but not limited to quiz questions, educational materials, graphics, logos, icons, images, audio clips, and software, is the property of iOxu Team or its licensors and is protected by intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes in accordance with these Terms.
6.3 Restrictions
You may not:
- Copy, modify, or distribute App content without permission
- Use our trademarks or branding without authorization
- Create derivative works based on App content
- Use App content for commercial purposes
7. Disclaimers
7.1 Educational Purpose
iOxu is designed to supplement your exam preparation and should not be your sole study resource. We make no guarantees regarding:
- Exam success or specific test scores
- Accuracy of all quiz content
- Completeness of subject coverage
7.2 "As Is" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.3 No Guarantee of Availability
We do not guarantee that the App will be available at all times or that it will be free from errors, viruses, or other harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IOXU TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Service interruptions
- Computer damage or system failures
- Unauthorized access to your data
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Termination
9.1 Termination by You
You may stop using the App at any time. You may also delete your account through the App settings.
9.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the App at any time, without notice, for any reason, including but not limited to:
- Violation of these Terms
- Fraudulent or illegal activity
- Conduct harmful to other users or our services
- Extended period of inactivity
9.3 Effect of Termination
Upon termination, your right to use the App will immediately cease. Any provisions of these Terms that should survive termination will continue to apply.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Azerbaijan, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Azerbaijan.
11. Dispute Resolution
Before filing a claim against iOxu, you agree to try to resolve the dispute informally by contacting us at support@ioxu.app. We will attempt to resolve the dispute informally within 30 days.
12. General Provisions
12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
12.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
